Last updated: June 15, 2026

1. Introduction & Scope

This Privacy Policy (the "Policy") describes how Jeffrey Dulaney and EactiveNet, Inc. (together with their affiliated brands, ventures, and subsidiaries, "we," "us," or "our") collect, use, disclose, retain, and safeguard personal information when you visit, browse, or interact with the website located at jeffreydulaney.com (the "Site"), communicate with us, request or receive our products and services, or otherwise engage with us (collectively, the "Services"). It also explains the privacy rights and choices available to you and how you may exercise them.

This Policy applies to personal information we process as a controller in connection with the Services. It does not apply to information we process solely on behalf of, and under the instructions of, our business clients (where we act as a processor or service provider), nor to the practices of any third party that we do not own or control. Where we provide products or platforms under separate brands, additional or supplemental privacy notices may apply, and those notices will govern to the extent they conflict with this Policy.

Please read this Policy carefully. By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use the Services. Capitalized terms not otherwise defined have the meanings given to them under applicable data protection laws.

2. Who We Are (Data Controller)

For the purposes of the EU and UK General Data Protection Regulation ("GDPR"), the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), and other applicable data protection laws, the data controller (and, where applicable, the "business" within the meaning of the CCPA/CPRA) responsible for your personal information is:

  • Controller: Jeffrey Dulaney / EactiveNet, Inc.
  • Location: Goodyear, Arizona, United States of America
  • Contact form: Contact page

If you have any questions about this Policy or our data practices, or if you wish to exercise any of your privacy rights, please contact us using the details set out in Section 17 ("Contact Us"). We are committed to handling your personal information responsibly and in accordance with applicable law.

3. Information We Collect

We collect personal information in several ways: information you provide directly, information collected automatically through your use of the Services, information from cookies and similar technologies, and information we obtain from third parties. The categories of information we may collect include the following.

(a) Information you provide to us. We collect personal information that you voluntarily provide when you interact with us, including when you complete a contact or inquiry form, request a quote or consultation, subscribe to a newsletter or mailing list, purchase or register for products or services, participate in a survey or promotion, or otherwise correspond with us. This may include:

  • Identifiers and contact details, such as your name, email address, telephone number, mailing address, and company or organization name;
  • The content of your communications, including the subject and body of any message you send to us and any attachments or information you choose to include;
  • Transaction and commercial information, such as products or services purchased or considered, billing details, and records of correspondence relating to a purchase (note that payment card details are generally processed by our payment processors and are not stored by us); and
  • Any other information you elect to provide in the course of your engagement with us.

(b) Information collected automatically. When you access or use the Services, we and our service providers may automatically collect certain technical and usage information, including:

  • Internet Protocol (IP) address and approximate, IP-derived geographic location;
  • Device information, such as device type, operating system, screen resolution, and unique device identifiers;
  • Browser information, such as browser type, version, and language settings;
  • Usage data, such as the pages you view, the links you click, the date and time of your visit, the referring and exit pages, and the duration of your session; and
  • Log data automatically recorded by our servers and infrastructure providers in connection with your access to the Services.

(c) Cookies and similar technologies. We use cookies, web beacons, pixels, local storage, and similar technologies to operate the Site, remember your preferences, maintain your consent choices, and analyze traffic and performance. For a detailed description of the technologies we use and the choices available to you, please see Section 6 and our Cookie Policy.

(d) Information from third parties. We may receive information about you from third parties, including analytics and advertising providers, hosting and infrastructure providers, payment processors, social media platforms (for example, when you interact with our profiles or follow links to our pages), and other partners or publicly available sources. We combine this information with the information we collect directly to the extent permitted by applicable law.

4. How We Use Your Information

We use the personal information we collect for the following purposes, in each case only where a valid legal basis exists (see Section 5):

  • To provide, operate, maintain, and improve the Services, including delivering the products, content, and features you request;
  • To respond to your inquiries, fulfill your requests, provide customer support, and communicate with you about your account, transactions, or engagement;
  • To process and fulfill orders, manage billing and payments, and maintain accurate business and financial records;
  • To send administrative and transactional communications, such as confirmations, technical notices, security alerts, and updates to our terms and policies;
  • To send marketing and promotional communications where permitted, subject to your consent or your right to opt out (see Section 15);
  • To personalize your experience and present content and offers tailored to your interests;
  • To monitor, analyze, and improve the usage, performance, and security of the Services, including through analytics and aggregated reporting;
  • To detect, investigate, prevent, and respond to fraud, abuse, security incidents, and other harmful or unlawful activity, and to protect the rights, property, and safety of our users, the public, and us;
  • To establish, exercise, or defend legal claims, and to comply with applicable laws, regulations, legal processes, and governmental requests; and
  • For other purposes disclosed to you at the time of collection or to which you consent.

We may de-identify, anonymize, or aggregate personal information so that it can no longer reasonably be associated with an identified or identifiable individual, and we may use and retain such de-identified or aggregated data for any lawful business purpose.

5. Legal Bases for Processing

If you are located in the European Economic Area ("EEA"), the United Kingdom, or another jurisdiction that requires a legal basis for processing, we rely on one or more of the following lawful bases under Article 6 of the GDPR (and equivalent provisions of other applicable laws) when we process your personal information:

  • Consent (Art. 6(1)(a)): where you have given us clear, specific, and informed consent to process your personal information for a particular purpose, such as sending you marketing communications or placing non-essential cookies. You may withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
  • Performance of a contract (Art. 6(1)(b)): where processing is necessary to perform a contract with you, or to take steps at your request prior to entering into a contract, such as responding to your inquiry, providing a requested service, or fulfilling an order.
  • Compliance with a legal obligation (Art. 6(1)(c)): where processing is necessary to comply with our legal and regulatory obligations, such as tax, accounting, and record-keeping requirements, or responding to lawful requests from authorities.
  • Legitimate interests (Art. 6(1)(f)): where processing is necessary for our legitimate interests or those of a third party, provided those interests are not overridden by your interests or fundamental rights and freedoms. Our legitimate interests include operating, securing, and improving the Services, preventing fraud and abuse, understanding how our Services are used, and promoting our business in a measured and respectful manner.

Where we rely on legitimate interests, you have the right to object to the processing as described in Section 12. If you would like more information about the specific legal basis on which we rely for a particular processing activity, please contact us using the details in Section 17.

6. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to operate and secure the Site, remember your preferences and consent choices, measure and analyze traffic and performance, and, where applicable, support marketing activities. Cookies are small text files placed on your device; related technologies include web beacons, pixels, software development kits, and browser local storage.

We distinguish between strictly necessary cookies, which are required for the Site to function and cannot be switched off in our systems, and non-essential cookies (such as analytics and functional or marketing cookies), which we use only with your consent where required by law. When you first access the Site, you are presented with a cookie consent notice that allows you to accept or decline non-essential cookies.

You can also control cookies through your browser settings, including by blocking or deleting cookies; however, disabling certain cookies may affect the availability or functionality of the Site. For a full description of the specific cookies we use, their purposes and durations, and the choices available to you, please review our Cookie Policy, which forms part of this Privacy Policy.

7. How We Share Information

We do not sell your personal information. We share personal information only as described in this Policy and as permitted by applicable law, including in the following circumstances:

  • Service providers and processors: with third-party vendors, consultants, and other service providers who perform services on our behalf — such as website hosting and infrastructure, email and communications delivery, analytics, payment processing, customer support, and security — and who are authorized to process personal information only as necessary to provide those services and in accordance with our instructions and appropriate confidentiality and data-protection obligations.
  • Legal, compliance, and safety: with courts, regulators, law enforcement, governmental authorities, or other third parties where we believe in good faith that disclosure is necessary to comply with a legal obligation, court order, or lawful request; to enforce our terms and agreements; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of our users, the public, or us.
  • Business transfers: in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or other business transaction, in which personal information may be transferred or disclosed as part of the transaction, subject to the protections described in this Policy or a successor policy.
  • With your consent or at your direction: with other parties when you have given us your consent to do so or have otherwise directed us to share your information.
  • Affiliates: with our affiliated companies, ventures, and brands for purposes consistent with this Policy.

We do not sell personal information for monetary or other valuable consideration, and we do not "share" personal information for cross-context behavioral advertising within the meaning of the CCPA/CPRA. If our practices change, we will update this Policy and provide any notice or choice required by applicable law.

8. Third-Party Services & Links

The Services may contain links to, or integrations with, third-party websites, platforms, products, and services that we do not own or control, including social media platforms, payment processors, and the various products, platforms, and companies referenced on our Site. These links and integrations are provided for your convenience and information.

We are not responsible for the privacy practices, content, security, or data handling of any third party. The collection, use, and disclosure of your information by third parties is governed by their own privacy policies and terms, not by this Policy. We encourage you to review the privacy policies of any third-party site or service before providing your personal information or otherwise interacting with it.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, as described in this Policy, unless a longer retention period is required or permitted by law. The criteria we use to determine our retention periods include:

  • The length and nature of our relationship with you and the duration for which we actively provide the Services to you;
  • Whether we have a legal, regulatory, tax, accounting, or contractual obligation to retain the information;
  • Whether retention is advisable in light of our legal position, such as for the establishment, exercise, or defense of legal claims, the enforcement of our agreements, or the resolution of disputes; and
  • The sensitivity of the information and the potential risk of harm from unauthorized use or disclosure.

When personal information is no longer required, we will securely delete, destroy, or irreversibly anonymize it in accordance with our internal retention and disposal practices and applicable law. Where deletion is not immediately feasible (for example, because the information is stored in backup archives), we will securely isolate the information and protect it from further processing until deletion is possible.

10. Data Security

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, loss, or destruction. These measures may include encryption in transit, access controls and authentication, network and application security practices, and ongoing monitoring and review of our security posture, in each case proportionate to the nature of the information and the risks involved.

Despite our efforts, please be aware that no method of transmission over the Internet, and no method of electronic storage, is completely secure, and we cannot guarantee the absolute security of your personal information. You are responsible for maintaining the confidentiality of any credentials associated with your use of the Services and for taking reasonable precautions to protect your information. If we become aware of a security incident that affects your personal information, we will notify you and the appropriate authorities to the extent required by applicable law.

11. International Data Transfers

We are based in the United States, and the personal information we collect may be stored and processed in the United States or in other countries where we or our service providers operate. These countries may have data protection laws that differ from, and may be less protective than, the laws of your country of residence.

Where we transfer personal information from the EEA, the United Kingdom, or other jurisdictions that restrict cross-border transfers to a country that has not been recognized as providing an adequate level of protection, we implement appropriate safeguards as required by applicable law. These safeguards may include the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum, where applicable), supplementary technical and organizational measures, or other lawful transfer mechanisms. You may request more information about the safeguards we have put in place by contacting us using the details in Section 17.

12. Your Privacy Rights

Depending on where you live and subject to applicable law, you may have certain rights regarding your personal information. We honor these rights in accordance with the requirements of the laws that apply to you. The rights described below are not absolute and may be subject to exceptions or limitations.

(a) EEA and UK Residents (GDPR)

If you are located in the EEA or the United Kingdom, you have the following rights under the GDPR:

  • Right of access: to obtain confirmation of whether we process your personal information and to receive a copy of that information;
  • Right to rectification: to have inaccurate personal information corrected and incomplete information completed;
  • Right to erasure ("right to be forgotten"): to request deletion of your personal information in certain circumstances;
  • Right to restriction of processing: to request that we limit the processing of your personal information in certain circumstances;
  • Right to data portability: to receive your personal information in a structured, commonly used, and machine-readable format and to have it transmitted to another controller where technically feasible;
  • Right to object: to object to processing based on our legitimate interests and to object to processing for direct marketing purposes at any time;
  • Right to withdraw consent: to withdraw any consent you have given at any time, without affecting the lawfulness of processing before withdrawal; and
  • Right to lodge a complaint: to lodge a complaint with your local data protection supervisory authority if you believe our processing infringes applicable law.

(b) California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the CCPA/CPRA:

  • Right to know: to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we disclose it;
  • Right to delete: to request deletion of personal information we have collected from you, subject to certain exceptions;
  • Right to correct: to request correction of inaccurate personal information we maintain about you;
  • Right to opt out of sale or sharing: to direct us not to sell or share your personal information. As stated in Section 7, we do not sell or share personal information as those terms are defined under the CCPA/CPRA;
  • Right to limit use of sensitive personal information: to direct us to limit the use and disclosure of sensitive personal information to that which is necessary to provide the Services; and
  • Right to non-discrimination: to not receive discriminatory treatment for exercising any of your privacy rights.

Because we do not sell or share personal information, no "Do Not Sell or Share My Personal Information" mechanism is required to halt such activity; however, we honor applicable opt-out preference signals as described in Section 13.

How to Exercise Your Rights

To exercise any of the rights described above, please contact us through our Contact page. We will respond to your request within the timeframes required by applicable law. To protect your privacy and security, we may need to verify your identity before fulfilling your request, and we may ask for additional information for that purpose. You may use an authorized agent to submit a request on your behalf where permitted by law, subject to verification of the agent's authority. We will not discriminate against you for exercising your rights.

13. Do Not Track & Global Privacy Control

Some web browsers offer a "Do Not Track" ("DNT") signal that you can set to express your preference not to be tracked across websites. Because there is currently no consistent industry or legal standard for recognizing and responding to DNT signals, our Site does not respond to DNT signals at this time. We will update this Policy if a uniform standard is adopted.

Where required by applicable law, we honor recognized opt-out preference signals, such as the Global Privacy Control ("GPC"), transmitted by your browser or a browser extension. When we detect a valid GPC signal, we treat it as a request to opt out of the sale or sharing of personal information for the browser or device from which the signal is received, to the extent such activity would otherwise occur. As noted above, we do not sell or share personal information.

14. Children's Privacy

The Services are intended for a general audience and are not directed to children. Consistent with the Children's Online Privacy Protection Act ("COPPA"), we do not knowingly collect or solicit personal information from children under the age of 13. More broadly, we do not knowingly collect personal information from minors under the age of 16 without appropriate consent where required by applicable law.

If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us using the details in Section 17, and we will take reasonable steps to delete such information from our records. If we become aware that we have collected personal information from a child in a manner inconsistent with applicable law, we will promptly delete it.

15. Marketing Communications

With your consent where required, or as otherwise permitted by applicable law, we may send you marketing and promotional communications about our products, services, and offerings. We are committed to honoring your communication preferences and complying with the CAN-SPAM Act and other applicable anti-spam and electronic marketing laws.

You may opt out of marketing communications at any time by following the unsubscribe instructions included in each marketing email, or by contacting us through our Contact page. We will process your opt-out request promptly, as required by law. Please note that even if you opt out of marketing communications, we may still send you non-promotional, transactional, or administrative communications relating to your account, transactions, or the Services, as these are necessary to our relationship with you.

16. Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the "Last updated" date at the top of this Policy and post the updated version on this page.

If we make material changes, we will provide additional notice as required by applicable law, which may include notifying you by email or through a prominent notice on the Site, and, where required, obtaining your consent. We encourage you to review this Policy periodically to stay informed about how we protect your personal information. Your continued use of the Services after the effective date of an updated Policy constitutes your acceptance of the changes to the extent permitted by law.

17. Contact Us

If you have any questions, concerns, or requests regarding this Privacy Policy or our handling of your personal information, please contact us:

We will make every reasonable effort to address your inquiry and resolve any concerns in a timely manner and in accordance with applicable law.
